Welcome to Innovative Legacy. These Terms of Service govern your access to and use of the Innovative Legacy website, the Myeko application, and all related services (collectively, the "Services") provided by Innovative Legacy LLC ("Innovative Legacy," "we," "us," or "our").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.
Innovative Legacy provides tools and platforms that help individuals preserve and share their personal legacy. Through our subsidiary brand Myeko, we offer an application that allows users to create a digital representation of themselves ("Eko") using voice recordings, photographs, and conversational data. The specific features and availability of our Services may change from time to time.
You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the Services on behalf of a minor, you represent that you are their parent or legal guardian.
Some features of our Services require you to create an account. You agree to provide accurate, current, and complete information during registration and to update that information to keep it accurate. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
When you create an Eko, you will receive a unique code that allows others to access your Eko through the Myeko application. You are responsible for keeping your code secure and only sharing it with individuals you intend to grant access. Innovative Legacy is not responsible for unauthorized access resulting from your sharing of your code.
You retain all ownership rights in the content you provide to create your Eko, including voice recordings, photographs, written responses, and any other materials you upload ("User Content"). By submitting User Content to our Services, you grant Innovative Legacy a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify, and display that content solely for the purpose of providing and improving our Services.
You represent that you own or have the necessary rights to all User Content you submit, and that the User Content does not infringe on the rights of any third party. You agree not to submit User Content that is unlawful, defamatory, obscene, or otherwise objectionable.
When you share your Eko code with others, you are granting them the ability to interact with your Eko through the Myeko application. This access is non-commercial and intended for personal, family use. You should only share your code with individuals you know and trust.
Your privacy is important to us. The collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at innovativelegacy.app/privacy.html to understand how we handle your data.

We strive to keep our Services available and functioning, but we do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue any part of our Services at any time, with or without notice. We are not liable for any loss or damage resulting from downtime, data loss, or service interruptions.
All content, features, and functionality of our Services, including but not limited to text, graphics, logos, software, and trademarks, are owned by Innovative Legacy LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.
The Myeko name, logo, and related marks are trademarks of Innovative Legacy LLC.
Our Services may contain links to or integrate with third-party websites, applications, or services that are not owned or controlled by Innovative Legacy. We have no control over and assume no responsibility for the content, privacy practices, or availability of any third-party services. Your interactions with third-party services are governed solely by those third parties' own terms and policies.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
Innovative Legacy does not warrant or make any representations regarding the accuracy, completeness, or reliability of any content generated by or displayed through our Services. You acknowledge that the Myeko application uses artificial intelligence and that outputs may not be accurate, complete, or reflective of your actual intentions or personality.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INNOVATIVE LEGACY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED US DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Innovative Legacy and its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your use of our Services.
We may update or modify these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on our website and updating the "Effective Date" at the top of this page. Your continued use of our Services after any such changes constitutes your acceptance of the revised Terms.
We may suspend or terminate your access to our Services at any time, with or without cause, with or without notice. Upon termination, your right to use our Services will cease immediately. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States of America, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Illinois for any disputes arising out of or related to these Terms or our Services.
